Nomeclatures

We / Us: when we speak of “Furry Auction” “we”, and “us”, we mean ourselves, the provider of the service.

Hedera: Hedera is the developer of HBAR, and is not affiliated to us. When we speak of "Hedera", we mean Hedera Hashgraph, LLC.

HBAR: Hedera's cryptocurrency.

Payment: A payment, in this context, is when we send the 90% of the your auction sale to your HBAR wallet.

Anonymous: Visitors of the site who didn't put their data there in any way, such as filling out a form and auctioning a NFT.

Users: Visitors of the site who shared or are about to share data with us in any way or another, such as filling out a form and auctioning a NFT.

User generated content

Users can send us content along with their personal data.
Both anonymous and users can see User Generated Content while using this website.

With regard to content added or published by the User on the Service (hereinafter the “User Content”), the user shall continue to hold all rights over it and accept all liability in the event of such content infringing the rights of any third party.

We're not responsible of the User Content and shall not be held liable for any loss or damage in respect of the User Content. when an user submits a form, the user agrees to provide us with true, accurate and authentic information. To know more about the information you provide to us, please see our Privacy Policy.

If you're a copyright owner and you find User Generated Content that violates your copyright, contact us immediately in order to delete that content or to fill out a DMCA.

Uploading user generated content

When you send a form in this website, you're sending your personal data and the metadata (Such as Name, Description, Image) of the content you want to be on this website, you agree that:

By uploading any Digital Asset to furry.auction, you grant a non-exclusive, worldwide, perpetual royalty-free license to us to display, reproduce and distribute your content on any media for the purpose of operating and promoting this site.
Your content won't appear in this website until we come to an exclusive copyright agreement with you after contacting you explicitly saying that we've accepted your submission.
Submissions will be approved at the sole discretion of us. Eligibility for submissions is not guaranteed upon meeting the criteria, and participation in this program is at us sole discretion. Additional terms may apply, including those published here.
After the agreement, we will mint a NFT with your content. Even though we minted the NFT using the information you provided to us, it still falls under "User generated content" category, and therefore its policies will be applied to you.
1-3 days after your NFT gets sold (The auction time ends AND there was a bid at least higher the minimum HBAR threshold), we will contact you via email to do the payment. Note that any distributions may be taxable to you, and we may request additional information from you either before or after the distributions are made.
furry.auction reserves the right to charge fees, commissions, royalties or other charges (“Fees”) from time to time at its sole discretion.
There's NO WARRANTY that we will do the payments. We reserve the rights to not pay you for any reason, including but not limited to: Sold price lower than the fees to mint we paid, not enough HBARs to cover the refunds to the bidders or any other economical issue.
The exclusive license you gave to us will be transferred to the winner of the auction, and they'll be able to resell the NFT and transfer the license again to yet another winner.

Auctions

When you're in the marketplace and click on a token, you get in an auction page. Auctions are the we're selling artist's NFTs, and therefore, they're user generated content.

Every auction has a Token ID, an OwnerID and a date, and in order to bid, you must send HBARs to the OwnerID. We're not responsible for any HBARS lost during the transfer for any reason, such as an user misinput. Please read the "Legal disclaimers" category in this page for more info.
If you're not the highest bidder, you can bid as much HBARS you want in order to be the highest bidder. If you bid again, the current bid will be added along with all of your previous bids (Example: If you bid 30HBARS and then 39HBARS, you bidded 69HBARS. If you're the highest bidder, the amount of 69HBARS will be shown along your wallet address in the auction page. After the auction ends, the highest bidder will win the auction and no HBARS will be refunded. If you're not the highest bidder, all the HBARS you bidded will be refunded 0-3 days after the auction.
We reserve the rights to not refund your HBARS or to refund you an amount lower than you sent, for any reasons, including but not limited to: Account's been hacked, fees larger than the HBAR amount...
If you're a winner, please email us at: contact@furry.auction , with a title like "I WON THE [tokenID] AUCTION" ; we will reply you with a way to get a proof that you're actually the winner, and then, transfer the NFT and the license to you.

Children

By using furry.auction, you confirm that you are over the age of 13.
IF YOU ARE 13 OR OLDER BUT UNDER THE AGE OF 18, OR THE LEGAL AGE OF MAJORITY WHERE YOU RESIDE IF THAT JURISDICTION HAS AN OLDER AGE OF MAJORITY, THEN YOU AGREE TO REVIEW THESE TERMS WITH YOUR PARENT OR GUARDIAN TO MAKE SURE THAT BOTH YOU AND YOUR PARENT OR GUARDIAN UNDERSTAND AND AGREE TO THESE TERMS. YOU AGREE TO HAVE YOUR PARENT OR GUARDIAN REVIEW AND ACCEPT THESE TERMS ON YOUR BEHALF.
IF YOU ARE A PARENT OR GUARDIAN AGREEING TO THE TERMS FOR THE BENEFIT OF A CHILD OVER 13, THEN YOU AGREE TO AND ACCEPT FULL RESPONSIBILITY FOR THAT CHILD'S USE OF THE APP, INCLUDING ALL FINANCIAL CHARGES AND LEGAL LIABILITY THAT HE OR SHE MAY INCUR.

Legal disclaimers

To the fullest extent permitted by applicable law: in no event will furry.auction or any of its subsidiaries, affiliates, directors and employees be liable for any damages, whether direct, indirect, special, incidental, or consequential, of any kind (including, but not limited to, where related to loss of revenue, income or profits, loss of use or data, or damages for business interruption) arising out of or in any way related to the sale and purchase of Tokens or use of the furry.auction, the Site or otherwise related to these Terms, regardless of the form of action, whether based in contract, tort (including, but not limited to, simple negligence, whether active, passive or imputed), or any other legal or equitable theory (even if the party has been advised of the possibility of such damages and regardless of whether such damages were foreseeable.
furry.auction doesn't warrant that the website is error free and that the service will be uninterrumpted.
YOU ACCEPT THE INHERENT SECURITY RISKS OF PROVIDING INFORMATION AND DEALING ONLINE OVER THE INTERNET, AND AGREE THAT WE HAVE NO LIABILITY OR RESPONSIBILITY FOR ANY BREACH OF SECURITY.
WE WILL NOT BE RESPONSIBLE OR LIABLE TO YOU FOR ANY LOSSES YOU INCUR AS THE RESULT OF YOUR USE OF THE HEDERA HASHGRAPH NETWORK OR ANY CRYPTOCURRENCY WALLET, INCLUDING BUT NOT LIMITED TO ANY LOSSES, DAMAGES OR CLAIMS ARISING FROM: USER ERROR, SUCH AS FORGOTTEN PASSWORDS OR INCORRECT TRANSACTIONS; SERVER FAILURE OR DATA LOSS; CORRUPTED WALLETS; OR UNAUTHORIZED ACCESS OR ACTIVITIES BY THIRD PARTIES, INCLUDING BUT NOT LIMITED TO THE USE OF VIRUSES, PHISHING, BRUTEFORCING OR OTHER MEANS OF ATTACK AGAINST THE APP, HEDERA HASHGRAPH NETWORK, OR CRYPTOCURRENCY WALLETS.
NFTS ARE INTANGIBLE DIGITAL OBJECTS THAT EXIST ONLY BY VIRTUE OF THE OWNERSHIP RECORD MAINTAINED IN THE HEDERA HASHGRAPH NETWORK. WE HAVE NO CONTROL OVER THE HEDERA HASHGRAPH NETWORK AND MAKE NO GUARANTEES OR PROMISES IN RELATION TO THE SAME.
